| dc.description.abstract | 隨著科技的急遽發展，使人類獲得資訊的方式亦趨向於更感官性的享受，圖書館服務亦趨步於多元化的發展，其中視聽服務可謂代表，惟資訊傳僠媒體之智慧結晶多透過著作權來加以保護，因此如何兼顧公眾使用之公利與著作權人之私益，便成?重要課題。 民國八十一年六月十日公佈施行的我國新著作權法將舊法五章五十二條修正?八章一百十七條，八十二年又陸續修正公佈暨增修相關子法規定，修正幅度既深且廣，以應著作權國際化、自由化之趨勢，惟新法在美國貿易法301條款陰影下誕生，立法時間倉促，不少法理扭曲，造成我國各界適用新法的諸多困擾，除有待法學、司法界合理的闡釋、適度的判決外，圖書館界亦應亟思解決之道，以應新法的衝擊，本論文試就以下論點進行討論： 一、概述視聽媒體與著作權法之關係： 大致以視聽媒體與著作權相關法律規定之介紹，以及媒體科技對著作權法規範之影響?討論範疇。 二、析論我國著作權法對圖書館視聽服務之規範： 以我國八十一年、八十二年修正之新著作權法暨其相關法規?討論對象，其有關圖書館視聽服務中錄音著作與錄影著作之一般性規範及特別性規範，均在本論文中作整體性的介紹，並兼論外國法理與實務上相關之規範，以供參酌。 三、分析我國著作權法對圖書館視聽服務之影響： 以圖書館實務?驗證，提出我國圖書館視聽服務適用著作權法規範所遭遇之困難及其處理原則，並兼及圖書館實務上所應注意之處，以免觸法而不自知。 最後，筆者試就以上所述之問題與疑義，提出個人芻見，以供圖書館界實務及未來修法之參考，冀望在讀者館藏之使用與著作權人之權利保護，求取最適當之衡平。 | zh_TW |
