| dc.description.abstract | 社會企業係一種取之於社會用之於社會的概念，不同於傳統非營組織需依靠他人之協助或資金援助，其係藉由商業模式賺取改變社會之資本。且不同於傳統營利組織在進行商業過程中不斷製造社會與環境問題，相對地，社會企業之設立初衷即解決社會與環境問題，並不斷地藉由創新之方式，採取對社會與環境更友善與更有利之經營方式。
目前歐美各國皆有設計社會企業相關政策以及立法，希冀藉由社會企業之運作，達到社會與環境問題之解決。而目前我國正由經濟部主導推動社會企業行動方案，希望藉由青年創業以及新創事業加入社會企業之一環，達到經濟、環境、社區發展等多重功效。該社會企業行動方案政策由103開始至105年，2016年之結束代表著該政策推動到了新的一個階段。雖然社會行動方案之政策已結束，但不代表社會企業之發展係屬曇花一現，而係要依賴在台灣的每一個人民一同去努力經營社會企業之發展。2017年代表著是社會企業更進一步與更重要之一年。 此外，我國目前亦藉由公司法全盤修正之時，藉由部分公司法條文之修正，改善目前公司型社會企業經營之困境。或者，更進一步，評估是否進行公司型社會企業專法之立法，以便提供給另一個組織型態給致力於社會企業之經營者選擇。而目前公司型社會企業專法之設計模式有兩種版本，一種是由2014年立法院所提出之「公益公司法草案」，另一種是2016年底由公司法全盤修正委員會所提出「兼益公司」專章。兩種立法版本之必要性及優缺點，應有分析及研究之必要。並可藉由研究外國立法例去比較兩者立法版本，深入探討是否有立法上之缺失或立法漏洞之部分。 | zh_TW |
| dc.description.abstract | Social enterprises is different from the traditional non-profit organizations which rely on financial support . It use commercial method to earn capital which can change the world. And Social Enterprise is also different from the traditional profit organizations which produce social and environmental issues when they earn money. In contrast, social enterprises are established to solve social and environmental problems, and continue to adopt a more friendly mode of operation to society and the environment .
In the United States, a benefit corporation is a type of for-profit corporate entity, authorized by 30 U.S. states and the District of Columbia that includes positive impact on society, workers, the community and the environment in addition to profit as its legally defined goals. A community interest company is a type of company introduced by the United Kingdom government in 2005 under the Companies (Audit, Investigations and Community Enterprise) Act 2004, designed for social enterprises that want to use their profits and assets for the public good. R.O.C is led by the Ministry of Economic Affairs to promote social enterprise action program（社會企業行動方案）. Hope that through youth entrepreneurship and new venture to join the social enterprise.
