| dc.description.abstract | 隨著家庭暴力防治法通過，我國的家庭暴力防治工作進入法治階段，但從實習經驗中發現許多留在施暴者身邊的受暴婦女基於種種考量不一定想採取法律行動，相關研究對於這群受暴婦女的理解也經常建立在她們為何不離開的問句之上，普遍未能正視受暴婦女留在施暴者身邊的處境，實務工作者也經常對於如何協助這群受暴婦女充滿無力感。因此，本研究期待能夠從這群受暴婦女的主體經驗中出發，並融入實務工作者的想法與觀察，重新理解受暴婦女留在施暴者身邊的處境，檢視目前服務協助這群婦女的合適性，並進一步討論如何才能協助受暴婦女和施暴者同住的情況下也能擁有安全與自主的服務方法。
本研究採用質性研究的深度訪談法，透過機構介紹訪談6位和施暴者同住的受暴婦女（但有1位訪談時已和施暴者離婚分居）和6位實務工作者。研究分析主要分成兩部分，一部分從時序脈絡整理受暴婦女留在施暴者身邊的想法與因應暴力的歷程，並進一步討論其減緩暴力的行動；一部分呈現留在施暴者身邊的受暴婦女與服務體系互動的情形，並討論修復式正義在台灣運作的可行性。研究發現留在施暴者身邊的受暴婦女絕非被動無助的接受暴力，而是不斷審慎評估自己和小孩的安全，處處展現自主的考量。實務工作者主動的傾聽、關心與支持則是受暴婦女認為最有幫助的服務，但實務工作者經常礙於個案量大與流動率高，使得穩定的陪伴不易獲得。台灣目前以司法體系介入為主的服務不但面臨公權力介入不足的隱憂，婚姻暴力調解制度也與修復式正義的理念相去甚遠，資源的挹注又偏重在緊急救援下，經常使受暴婦女無法得到充分的支持，且在接受服務的過程承擔許多風險。但同樣身處制度不完備下的實務工作者仍試圖從中找到突破困境的出路，提出與留在施暴者身邊的受暴婦女工作可努力的方向。最後根據研究結果從掌握及早介入的契機、建構多元的服務與完善目前司法體系介入的配套措施三方面提出建議。 | zh_TW |
