| dc.description.abstract | 安全和人權是文明社會裡的根本，然而反恐怖主義的安全措施，卻會使安全和隱私權兩者間，有不同程度的衝突，在選擇維繫安全和保障人權間，國際社會間往往很難達到平衡。而聯合國作為當今世界反恐最重要的國際組織，必須意識到自己作為全球反恐的行動者，肩負協助締約國處理反恐措施和人權衝突的職能，在反恐聲浪中應該謹守哪些原則，才能平衡安全跟隱私的天平。
本文嘗試在聯合國的規範體系中找出兩者間的平衡點，在第二章主要聚焦在聯合國對恐怖主義的回應，藉由分析聯合國文件及規範，全面地理解聯合國對恐怖主義的對策。第三章探討聯合國對隱私權的保護，藉由案例和聯合國文件來建構ICCPR對隱私權保護的重要原則。第四章回歸到反恐措施上面，利用ICCPR的重要原則來檢討安全措施的合法性。 | zh_TW |
| dc.description.abstract | Both security and human rights are important to all within the civilized world. Coun-ter terrorism security measures that encroach to varying degrees on individual privacy are causing a clash between two sets of values: security and the right to privacy. For instance, it may not be easy for the international community to reconcile well intentioned acts to maintain security and to preserve human rights. As the most important international organ-ization, United Nations (UN) must be aware of its responsibility of assisting States parties in dealing with the conflict between counter-terrorism and human rights, and should be kept in what fundamental principles.
This thesis tries to find out the balance point between the security and privacy. Chap-ter 2 investigates the UN’s response to terrorism and the protection of privacy. Through an analysis of the UN’s resolutions and Conventions, it helps build a comprehensive view of the UN response to terrorism. It shows how the UN has enhanced the formulation and advancement of international norms and principles governing terrorism. Chapter 3 focuses on protection of privacy, how UN constitutes those fundamental principles, which basical-ly through the discussion of ICCPR. Chapter 4 back to the counter-terrorism measures above, reviewing the legitimacy of security measures with ICCPR important principles. | en |
