人工智慧對律師事務所管理變革的影響及應對策略

Abstract

本選題在梳理和總結國內外先進研究成果和已應用的人工智慧運作體系的基礎上，通過對當前法律服務行業和律師事務所管理中常見的資訊化壁壘、運作模式保守單一的問題原因進行剖析，展望和設計出符合人工智慧發展趨勢的、前瞻合理的管理體系。本選題首先通過彙集和整理多種研究文章和商業報告，對人工智慧的商業應用加以綜述。綜合採用歷史的、哲學的批判反思的方法，追本溯源，梳理和分析人工智慧的緣起、代際更新、商業浪潮的到來，對人工智慧的內涵及其在人類文明演化中的位置與功能作出分析和預判，奠定了進一步研究的理論基礎。採用調查與商業案例分析相結合的方法，對國內外已經得到有效應用的人工智慧商業管理模式進行案例化探討，使得當前法律服務資訊化建設中的常見標準、管理模式、軟體平臺以及長期規劃的制定與建設工作形成一個明晰可見的背景化縮影鋪墊。 隨後，提出了人工智慧對律師事務所管理價值鏈的重塑問題。對人工智慧在法律行業、律師事務所管理變革的意義和作用上該如何看待、如何操作的問題，結合律師事務所管理的特殊性進行更進一步的探索，以供討論和參考。試思考和分析了律師事務所應用人工智慧戰略設計和管理策略。從發展趨勢、戰略設計、管理策略多個角度，對第一手獲得的國內律師事務所的管理資料和數據加以深入分析，對人工智慧在律師事務所管理方法與實踐領域的滲透和改造，以及大數據理念、方法技術和大數據資源管理背景下新型的管理趨勢、戰略和具體方法進行探討。

On the basis of summarizing advanced research outcomes both home and abroad, along with artificial intelligence operation system which is already in use, this topic has analyzed current legal service industry and common issues in law firm’s governance such as information barriers and operation mode’s conservation, put forward and designed a governance system which fit artificial intelligence’s development trend and reasonable prospection. First, this topic has done a thorough literature review of artificial intelligence’s business application by collecting and sorting out multiple research articles and business reports. Integrated research methods of historical, philosophical and critical reflection are used to track sources and analyze artificial intelligence’s commence, intergenerational update and business wave’s outcome. In addition, research methods are used to analyze and prejudge artificial intelligence’s connotation and its position and function in evolution of human civilization, which lay the theoretical foundation of further research. Survey combined with business cases analysis is used to discuss already applied artificial intelligence’s mode in both home and abroad. This makes common standard, governance mode, software platform and formulation and construction of long term planning in legal service information construction be a clear miniature. Afterwards, artificial intelligence’s remodeling on law firms’ management value chain is put forward. Considering the particularity of firms’ governance, how to see and how to operate artificial intelligence’s significance and function on legal industry and firms’ governance change, are furtherly explored for discussion and reference. At last, the author has tried to reflect and analyze the strategic design and governance methods of law firms’ application on artificial intelligence. In-depth analysis on first hand of law firm’s governance information and data has done from the perspectives of development trend, strategic design and governance methods. Artificial intelligence’s penetration in transformation on governance methods and practice frontiers of law firms, as well as big data concept, method technology and newly governance trend, strategy and specific method under the background of big data resources management are discussed.
