摘要: | 本論文探討勞動基準法修正一例一休對勞資雙方競合利弊及因應策略,透過競合理論的模型初探勞資雙方利弊及因應。勞資雙方具有競爭與合作的關係,本論文探討勞資雙方在勞動基準法修正後「一例一休」新賽局中的情況,以達到勞資雙方穩定關係。
本論文先以相關文獻與理論基礎探討,理解一例一休、勞資競合關係,採取深度訪談法進行研究,針對一例一休修法之爭議,找各方之見解及問題,初探一例一休於勞資談判檢視與運作機制之設計,以解決一例一休目前之困境。 This research investigates the revised Labor Standard Act, where the employees are required to take one regular holiday off and one rest day off every week called “one regular leave day and one rest day.” We discusses the pros and cons of the revision of the Labor Standard Act with the theory of co-optition. Cooperations and competitions occurs between employer and employees and we examine the new possible relationship between them. This research explains the idea of amendement of the revised Labor Standard Act by reviewing relevant literatures and conducting a questionnaire survey. We try to medigate the delima of revised Labor Standard Act by examining the possible mechanism design of “one regular leave day and one rest day.” |
