In recent years, following the domestic implementation of the Convention on the Rights of Persons with Disabilities (CRPD), human rights principles have gradually been incorporated into Taiwan's Mental Health Act. Nevertheless, under the current Mental Health Act and other relevant legal frameworks, persons with mental disorders and psychosocial disabilities continue to be assigned different legal statuses, rights, and obligations. Furthermore, certain institutional arrangements and practical implementations remain subject to concerns regarding human rights protection. This study aims to explore the treatment arrangements and legal governance of persons with mental disorders and psychosocial disabilities in Taiwan through a qualitative research approach. First, a literature review was conducted to examine the legislative development of the Mental Health Act and its implications for different institutional contexts. Data were then collected through landmark case analysis and semi-structured interviews. Interview participants included experts, scholars, and members of non-governmental organizations (NGOs), enabling the study to capture diverse perspectives on the treatment arrangements and legal governance of persons with mental disorders and psychosocial disabilities. Judicial decisions and interview data were subsequently analyzed to identify potential gaps and conflicts between institutional design and practical implementation. The study addressed three primary research questions: (1) What implementation difficulties may arise in practice following the revision of the new subordinate regulations under the Mental Health Act, and how might frontline practitioners respond to them? (2) How do experts, scholars, and NGO practitioners understand the institutional circumstances and support needs faced by persons with mental disorders and psychosocial disabilities, and their caregivers? (3) What are the views of experts, scholars, and NGO practitioners regarding the Mental Health Act and other laws related to the rights of persons with mental disorders and psychosocial disabilities, and what recommendations do they propose for safeguarding the rights of defendants with mental disorders and psychosocial disabilities? The study analyzed landmark cases and conducted semi-structured interviews with 14 participants, including 6 NGO practitioners and 10 experts and scholars. Two participants held dual roles as both NGO practitioners and experts/scholars; therefore, the actual number of interviewees was 14. The findings indicate that because some subordinate regulations were not promulgated and implemented according to the original schedule, many NGO practitioners were unable to provide comprehensive evaluations of the new system. From a human rights perspective, although Taiwan has revised certain provisions governing coercive measures in the Mental Health Act, the overall system continues to be predominantly based on a medical model. Interviewees generally emphasized the importance of caregiver support services and community resource integration. Moreover, practical implementation should further strengthen awareness of CRPD principles and place greater emphasis on the subjectivity of persons with mental disorders and psychosocial disabilities. From the perspective of judicial practice, the application of the Mental Health Act in most landmark cases primarily involved the determination of severe mental disorders and the use of compulsory hospitalization or compulsory treatment measures. In several cases examined in this study, courts demonstrated a more explicit review of the relationship between an individual's mental condition and the criminal act, the necessity of custodial protection measures, and issues concerning procedural safeguards and access to justice. Finally, regarding mental health literacy and social consensus, the findings suggest that mental health literacy should be incorporated into the education system to enhance public understanding of mental health issues. In addition, communication platforms between policymakers and frontline practitioners should be established so that practical experiences can serve as important references for future legal and policy reforms. Through an analysis of institutional frameworks and practical experiences, this study seeks to provide recommendations for future mental health policy development and legal reform in Taiwan.
