The development of the modern biopharmaceutical industry relies heavily on the patent system. However, because new drugs must undergo lengthy and rigorous regulatory reviews and human clinical trials before marketing, the effective patent term is significantly eroded. To compensate for this loss, various countries have successively introduced the Patent Term Extension (PTE) system. Nevertheless, in Taiwan’s practice regarding the determination of the "end date" for foreign clinical trial periods, a major discrepancy exists between the competent authority—the Taiwan Intellectual Property Office (TIPO) of the Ministry of Economic Affairs—and judicial practice. TIPO tends to recognize the "Study Completion Date" (the date on which the last subject completed the trial) as defined by the International Council for Harmonisation (ICH), which grants a shorter extension period. Conversely, recent prevailing judicial opinions hold that the "Clinical Study Report (CSR) Date," which encompasses data analysis and report writing, should be adopted instead. This conflict of opinions severely impacts pharmaceutical developers' Net Present Value (NPV) assessments regarding patent cliffs and revenue losses, thereby undermining legal predictability under the principle of the rule of law.
This thesis adopts a dual approach combining comparative law and literature analysis. First, it traces the historical and jurisprudential foundations of the patent extension system. Through empirical case studies of Pfizer's small-molecule drug Lipitor® and AbbVie's biologic drug Humira®, this thesis quantitatively analyzes the devastating impact of the "patent cliff" on global pharmaceutical revenues, thereby highlighting the immense financial value inherent in every single day of patent extension in commercial practice. Second, this thesis deeply analyzes and critiques TIPO’s policy rationale, which attempts to restrict the certification criteria for foreign trials under the guise of "attracting foreign companies to conduct clinical trials in Taiwan." The research indicates that the absolute core factor influencing multinational pharmaceutical companies' global clinical trial layouts and new drug introduction timelines lies in the pricing standards and market access mechanisms of Taiwan's National Health Insurance (NHI) drug reimbursement system, rather than a mere few months' difference in patent extensions. From the perspective of legal methodology, TIPO's viewpoint blurs the line between "rights compensation" and "industrial policy," and completely lacks empirical data support in economic practice.
Through an extensive and in-depth comparison of the legal frameworks and recent practical developments in key pharmaceutical markets—including the United States, the European Union, South Korea, and Japan—this thesis finds that Taiwan's current statutory framework is the root cause of numerous microscopic disputes over date determination. To fundamentally resolve this institutional deadlock, this thesis proposes specific recommendations: in the short term, TIPO should immediately amend its Patent Term Extension Examination Guidelines in accordance with judicial rulings to fully adopt the Clinical Study Report completion date standard, thereby complying with the principle of legal reservation and the principle of equality. For long-term legal development, Taiwan should advance amendments to the Patent Act to explore the introduction of a macro formula-based calculation model. This would fundamentally eliminate litigation over the detailed dates of individual clinical trials, establishing a highly predictable pharmaceutical patent extension system that balances both industrial innovation and public interest.
