摘要: 作品名稱之保護對於文化、娛樂產業之發展至關重要,但觀我國法制現狀,存在作品名稱保護不足的問題。經由檢視著作權法、商標法及公平交易法之立法目的,本文認為以商標法為依據完善作品名稱之保護最為適當,是以作品名稱在現行商標法上面臨之識別性問題即為本文研究問題核心所在。
透過對美國及歐盟法制之觀察,將分析美國及歐盟如何探討作品名稱之商標識別性此一問題,本文將逐一分析美國與歐盟法制上的論證過程,並嘗試從中找出值得我國法制借鏡之處。除了比較法制之研究,本文亦將以不具名來源準則之內容為依據,重新探討作品名稱是否具有識別性應如何解釋較為適當。本文認為依照不具名來源準則,作品名稱之識別性判斷應與一般標識之識別性判斷相同,並無為其另訂特殊規範之必要。同時本文主張現行行政規範與實務運作現狀宜作修正,方得使作品名稱在我國法制上獲得更加充足之保障。
The protection of titles of creative works is crucial to the development of cultural and entertainment industries. However, under the current Taiwanese legal framework, protection for titles of creative works remains insufficient. By examining the legislative intent of the Copyright Act, the Trademark Act, and the Fair Trade Act, this study argues that the Trademark Act serves as the most appropriate basis for enhancing the protection of titles of creative works. Accordingly, the core issue of this study lies in the challenge of establishing distinctiveness for titles of creative works under the existing Trademark Act.
By examining the legal frameworks of the United States and the European Union, this study analyzes how these jurisdictions address the issue of trademark distinctiveness in titles of creative works. It will review, in turn, the reasoning developed under U.S. and EU law, with the aim of identifying insights that may serve as useful references for Taiwan’s legal system. In addition to the comparative analysis, this study also revisits the question of whether titles of creative works possess distinctiveness by drawing on the principles reflected in the “anonymous source doctrine.” It argues that, under this doctrine, the assessment of distinctiveness for titles of creative works should follow the same standards applicable to other designations, and that there is no need to establish a separate regulatory framework for such titles. This study further contends that the current administrative regulations and practices in Taiwan should be revised to ensure that titles of creative works receive more adequate protection under the existing legal system.
